1. Identity of the company

Licences: Art of Investigations is licensed as a private investigator in accordance with the Act of 18 May 2024 (Private Investigators Act), under licence number 14.2073.11; and is authorised to operate a security advisory firm by the Federal Public Service Home Affairs, pursuant to the Act of 2 October 2017 regulating private and special security, under company number BE 1020.510.274.

2. Applicability

These general terms and conditions apply to all agreements, investigations, assignments, and services provided by Art of Investigations, unless otherwise agreed in writing.

3. Services

Art of Investigations provides services as a licensed private investigator and security advisory firm, including:
Private investigation
Inheritance investigations
Observations and discreet surveillance
Background checks
Business investigations
Support in conflict mediation
Establishments in family and social files
Investigations into fraud or unwanted behaviour (e.g. employees)
Collection of evidence for legal purposes
Locating persons, assets and property
Digital and open-source analysis within the legal framework
Security advisory
Risk and security analyses
Integrity and vulnerability analyses
Advice on organisational and preventive security measures
Advice on insider risk, information security and human risks
Support with security policy, procedures and governance
Awareness and strategic security advice for businesses and organisations
The specific assignment is agreed in writing with the client. The content and scope of the services are specified per assignment. This list is non-exhaustive.

4. Legal framework

Art of Investigations only operates within the scope of Belgian legislation, in particular the Act of 18 May 2024 (Private Investigators Act) regulating the profession of private investigator and the Act of 2 October 2017 regulating private and special security. Each assignment is carried out respecting privacy, proportionality and subsidiarity.

5. Client obligations

The client undertakes to provide correct and complete information necessary to perform the assignment. The client declares not to use the assignment in breach of the law and remains responsible for the ultimate use of any collected evidence.

6. Fees and payment

Unless otherwise agreed, work is performed at a fixed hourly rate, plus travel costs, mileage reimbursement and any additional expenses.
Quotes are valid for 30 days and are indicative; the final cost may vary depending on the duration and complexity of the assignment.
Invoices are payable within 14 days of the invoice date. For late payment, default interest of 8 % per year is due, in addition to a fixed compensation of 10 % with a minimum of 50.

7. Cancellation and termination

If an assignment is cancelled less than 48 hours before the scheduled start, a compensation of 30 % of the estimated amount may be charged. Art of Investigations reserves the right to refuse or terminate an assignment if it turns out to be illegal or incompatible with professional ethics.

8. Liability

Art of Investigations undertakes an obligation of means, not of result. Liability is limited to the value of the invoice amount, with a maximum of 1,000. Art of Investigations is not liable for indirect or consequential damage.

9. Reporting and evidence

The results of the investigation are reported in a written report, intended solely for internal and legal use. Distribution, publication or use of this report without the permission of Art of Investigations is prohibited, except where required by law.

10. Privacy and data processing

All assignments are carried out in compliance with the General Data Protection Regulation (GDPR). Personal data are processed only for the purpose of performing the assignment and are retained for as long as legally required. 11. Governing law and disputes

These terms are governed exclusively by Belgian law. Any disputes fall under the jurisdiction of the courts of Brussels, unless compellingly otherwise determined.
